In yet another change in trade promotions compliance in Australia, the ACT Gambling & Racing Commission has announced that permits are only required for trade promotion lotteries if the total prize pool exceeds $3,000. This is a significant shift – previously, permits were required regardless of prize value.

Trade promotions not requiring permits must still comply with the balance of the ACT gaming laws. This means that, in a nutshell, conditions of entry must include:

• Details regarding eligibility criteria (ie who can enter) and how to enter.
• Opening and closing dates.
• Full prize details.
• Time, date and location of the prize draw.
• Information as to how winners will be notified.
• The promoter’s full name, address and ABN/ACN.
• Unclaimed prize arrangements.

You might recall that Victoria did away with permits altogether back in June (if you didn’t know this, read our June blog on the topic).

This latest change leaves New South Wales as the only jurisdiction that requires permits be obtained regardless of the total prize pool. Will it come to the party? Watch this space.
