Electronic lodging of Plans of Subdivision and Consolidation via SPEAR
SPEAR is an online based lodging system operated by Land Use Victoria, allowing subdivision planning permit and certification applications to be compiled, lodged, managed, referred, approved and tracked online, anytime.
A few months ago we undertook our first ever lodging of a plan of subdivision via the SPEAR network. From start to finish, we were able to save our client time and money by completing the lodging process online and electronically as compared to physical attendance at Land Victoria and provision of (soon to be outdated) hard copy documents and supporting information. We have subsequently followed up with a further subdivision of the staged development via the SPEAR network, meaning the staged subdivision is one of the first in Victoria to occur solely through SPEAR.
The SPEAR network, primarily used by surveyors and relevant authorities (including municipal councils) for processing Subdivision Act related matters, assists in streamlining the registration process of transactions at Land Use Victoria. While it has for some time been used by other parties, functionability for solicitors and conveyancers as lodging parties has only recently been enabled.
The use of SPEAR reflects the increasing digitalisation of elements of the property development and conveyancing industry. At this stage, SPEAR does not fully communicate with PEXA (the online property exchange network) – resulting in a weird situation where PEXA treats the processes undertaken in SPEAR as if it were a paper-based transaction making some of the terminology and processes somewhat confusing. Nevertheless, having completed training with SPEAR and embracing innovative technologies, we were able to process the staged subdivision from the comfort of our offices. (Indeed, I processed part of the application while interstate on holiday.)
