Insolvency

Our expertise includes:

  • advising insolvency practitioners on a range of insolvent administrations, including bankruptcy and corporations matters
  • providing directors and owners of distressed businesses with advice on legal obligations along with restructuring and insolvency alternatives
  • conducting and defending litigious insolvency matters, including voidable transaction claims, insolvent trading claims, and public examinations
  • assisting with complex investigations into the affairs of insolvent entities, including bankrupt estates, and cross-border insolvency matters
  • advising and litigating corporations disputes, including shareholder oppression, just and equitable winding up claims
  • assisting secured creditors, lenders and mortgagees with enforcement actions, including applications for the appointment of receivers and managers or provisional liquidators
  • extensive expertise in personal insolvency, including personal insolvency agreements, compositions and prosecuting and defending claims over the property of a bankrupt estate, and
  • advising on priority disputes between secured creditors, including advice on personal property security under the Personal Property Securities Act 2009 (Cth).
Restructuring and special situations

In conjunction with the firm’s other practice groups, particularly the Corporate & Commercial group, we can assist in the implementation of any proposed restructure including the drafting and negotiation of sale of assets agreements, debt restructuring, capital raises, schemes of arrangement, the provision of advice in relation to employer obligations and the drafting of any necessary documentation.
